Mueller v. Commissioner

The taxpayer successfully concluded an Age Discrimination case and bargained for and received a single premium deferred variable annuity, the ownership of which remains in the defendant.

The Internal Revenue Service contended that the taxpayer “constructively received” the then current fair market value of the single premium annuity.  No. 11249-96 (U.S.T.C. 1996).
